Your Account

Creating an Account

You can create a free Propane account by signing up at usepropane.ai. You're responsible for keeping your login credentials secure and for all activity under your account.

Who Can Use Propane

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your company (if applicable). If you're using Propane for a company, you represent that you're authorized to bind that company to these Terms.

Account Security

You're responsible for maintaining the security of your account. If you believe your account has been compromised, contact us immediately at legal@usepropane.ai.

Using the Service
‍

What You Can Do

Propane provides an AI-driven customer intelligence platform. You can use it to gather insights, run AI agents, enrich customer profiles, and integrate with your existing tools - all for your internal business purposes.

Access

We grant you a limited, non-exclusive, non-transferable right to access and use the Services for as long as your account is active and in good standing.

Your Data

You own all the data you put into Propane. We process it only to provide the Services to you. See our Data Processing Agreement at https://usepropane.ai/legal/dpa for details on how we handle your data.

Pricing and Payment

Free Account

Creating a Propane account is free. You only pay for what you use - like completed AI agent sessions, enriched customer profiles, or incentive payouts to your users.

Usage-Based Pricing

Current pricing is available at usepropane.ai/pricing. We bill you monthly based on your actual usage. Invoices are due within 30 days.

Price Changes

We may change our pricing structure or introduce new fees at any time. We'll give you at least 30 days notice before any price increase takes effect. If you don't agree with the new pricing, you can cancel your account.

Enterprise Plans

If you sign up for an enterprise plan with custom pricing, your signed Commercial Agreement governs instead of these Terms.

What You Can't Do

Prohibited Uses

You may not:

• Use Propane to do anything illegal or harmful
• Upload or process content that violates laws, infringes IP rights, or contains hate speech, harassment, or discriminatory content
• Scrape, crawl, or use automated tools to access Propane in ways that exceed our published API rate limits or strain our infrastructure
• Attempt to bypass our security, rate limits, or access controls
• Reverse engineer, decompile, or attempt to extract our source code
• Resell, white-label, or provide Propane as part of your own product or service to third parties
• Use Propane to build a competing product or service
• Embed Propane components on domains or properties you don't own or where you don't have legal control and liability
• Launch denial-of-service attacks or flood our systems with requests
• Impersonate others or misrepresent your affiliation

Rate Limits and Abuse

Our API rate limits are documented at docs.usepropane.ai. If we observe patterns of abuse or excessive usage that threatens service availability, we may throttle your access or suspend your account with notice when practical.

Our Response to Violations

If you violate these Terms, we may suspend or terminate your account. We'll try to warn you first when reasonable, but we can act immediately for serious violations.

AI Agent Use
‍

Your Responsibility

You're responsible for how you configure and deploy AI agents. This includes:

• Ensuring agents don't violate laws or harm people
• Providing appropriate disclosures to end users interacting with AI agents
• Complying with data protection laws when collecting information through agents
• Not using agents to generate spam, harassment, or misleading content

The instructions and configurations you provide to your AI agents dictate their behavior. You're responsible for the content they generate based on your instructions.

Our Role

We provide the platform and tools. We're not responsible for how you use them or what your agents produce. While we may implement technical safeguards to prevent obvious misuse, you're ultimately responsible for your agents' behavior and outputs.

Cancellation and Termination

You Can Cancel Anytime

You can cancel your Propane account at any time through your account settings or by contacting support@usepropane.ai.

Billing After Cancellation

Since you're billed monthly in arrears for actual usage, there are no prepaid fees to refund upon cancellation. Any outstanding invoices for services already rendered remain due. If you have a custom prepaid agreement, refund terms are governed by that agreement.

We Can Suspend or Terminate

We may suspend or terminate your account if:

• You violate these Terms
• Your payment is more than 30 days overdue
• We need to comply with legal requirements
• Your use threatens the security or availability of our Services

We'll provide notice when practical, but we can act immediately if necessary. If we terminate your account for cause, no refunds are due.

What Happens After Termination

After your account is terminated, we'll delete your data according to our Data Processing Agreement (typically within 60 days). You can export your data before termination.

Intellectual Property

We Own Propane

Propane, our platform, technology, software, designs, and branding belong to us. These Terms don't transfer any ownership to you.

You Own Your Data

You retain all rights to the data you put into Propane. By using our Services, you grant us permission to process that data solely to provide the Services.

Feedback

If you provide Propane with any suggestions, ideas, enhancement requests, recommendations, or other feedback ("Feedback"), you do so at your own risk and acknowledge that Propane has no obligations (including obligations of confidentiality or compensation) with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback and that it does not violate any third-party intellectual property rights. You grant Propane a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and sublicensable right and license to use, reproduce, modify, create derivative works from, distribute, and otherwise exploit the Feedback in any manner for any purpose, including to develop, improve, and market Propane's products and services.

Privacy and Data Protection

Your Privacy

How we collect, use, and protect your data is described in our Privacy Policy at https://usepropane.ai/privacy-policy.

Data Processing

When you use Propane, we act as a data processor on your behalf. Our obligations and your rights are set out in our Data Processing Agreement at https://usepropane.ai/legal/dpa.

No AI Training

We don't use your data to train our AI models. See our DPA for details.

Service Availability
‍

Uptime

We aim for 99.5% uptime each month. See our Service Level Agreement at https://usepropane.ai/legal/service-level-agreement for details on uptime commitments and service credits.

Status Page

Check current and historical availability at status.usepropane.ai.

Maintenance

We may occasionally need to take Propane offline for maintenance. We'll notify you at least 24 hours in advance when practical.

No Guarantees

We provide Propane "as is" without warranties of any kind. We don't guarantee that it will always be available, error-free, or meet your specific needs.

Limits on Our Liability

Exclusion of Consequential Damages

Except with respect to breaches of confidentiality obligations or our Data Processing Agreement, we're not liable for any indirect, incidental, special, consequential, or punitive damages, even if we've been advised they might occur.

What We're Never Liable For

We're never liable for:

• Special or punitive damages
• Lost profits, lost business, or lost revenue (except if you breach your license rights)
• Cost of substitute goods or services
• Problems caused by your misuse of Propane
• Third-party services or integrations you connect to Propane
• Data loss if you didn't follow our backup recommendations
• Downtime caused by factors outside our control
• Content or outputs generated by AI agents you configure

Liability Cap

Our total liability to you is limited to the fees you paid us in the 12 months before the issue arose, or €1,000, whichever is greater.

Exceptions to the Cap:

• Data Breaches: For unauthorized disclosure of your data caused by our failure to comply with our DPA, our liability is capped at fees paid in the preceding 12 months only (no €1,000 minimum).
• Intellectual Property: Claims based on either party's breach of IP rights are not subject to the caps above.

Your Indemnity

You'll defend us against claims arising from your use of Propane, your violation of these Terms, content you process through our Services, or outputs generated by AI agents you configure and deploy.

Changes to These Terms

We May Update These Terms

We can change these Terms at any time. If we make material changes, we'll notify you by email or through the Service at least 30 days before they take effect.

Your Options

If you don't agree with the changes, you can cancel your account before they take effect. Continuing to use Propane after changes become effective means you accept them.

General Legal Stuff
‍

Entire Agreement

These Terms, along with our Privacy Policy and DPA, are the complete agreement between us.

Governing Law

These Terms are governed by the laws of Denmark. Any disputes will be resolved in the courts of Copenhagen, Denmark.

No Partnership

These Terms don't create any partnership, joint venture, or agency relationship between us.

Severability

If any part of these Terms is unenforceable, the rest remains in effect.

No Waiver

If we don't enforce a provision, that doesn't mean we waive our right to enforce it later.

Assignment

You can't transfer these Terms to anyone else. We can transfer them to an affiliate or in connection with a merger or acquisition.
